Terms and Conditions for Candidates
1. Introduction
- Welcome to Hex: By registering as a candidate on Hex, you agree to these Terms and Conditions, which govern your access to and use of Hex’s job-matching services specifically for e-commerce positions.
2. Service Overview
- Hex serves as a job-matching platform connecting candidates like you with e-commerce companies seeking qualified professionals. While Hex facilitates initial introductions, all employment decisions rest with the companies, not Hex.
3. Candidate Obligations and Responsibilities
- Information Accuracy: You agree to provide complete and accurate information during your registration and throughout the screening process. Hex reserves the right to suspend or terminate your profile if any false or misleading information is detected.
- Ongoing Updates: If your experience or job preferences change, you should update your information to ensure Hex can match you with appropriate opportunities. You will be contacted via email or through the Hex platform, as applicable.
- Account Management: Your are responsible for managing your account, keeping login credentials secure, and immediately notifying Hex of any unauthorized access or suspicious activity on your account.
4. Screening and Selection Process
- Candidates will progress through a multi-step screening process, with each step based on your performance and Hex’s discretion. Completion of the screening does not guarantee job placement or engagement with any specific employer.
5. Candidate Data Usage
- By submitting your profile, you consent to Hex storing, processing, and sharing your personal information with potential employers. Hex respects your privacy and uses your data only to facilitate job matches and related services, adhering to applicable data privacy regulations.
6. Limitation of Hex's Role
- No Endorsement or Guarantee: Hex does not conduct exhaustive background checks on employers nor guarantee the legitimacy or quality of any employer or job opportunity, or the accuracy of any job posting.
- Candidate Responsibility: It is your responsibility to conduct due diligence on potential employers, understand the job terms offered, and negotiate the terms directly with the employer before accepting any position. You are not obligated to accept or pursue any job opportunity that is presented to you.
7. Disclaimer and Release of Liability
- Employment Terms: Hex is not involved in negotiating employment terms or resolving employment-related disputes. Hex disclaims any liability arising from employer behavior, treatment, or employment practices once a candidate is engaged.
- Platform Limitations: Hex provides job-matching services "as-is" without any warranty or guarantee of outcomes, job placements, or employment conditions. Hex does not warrant that the platform will operate error-free or that it will be continuously available. Hex hereby disclaims all warranties, whether express or implied, including the warranty of merchantability, fitness for a particular purpose and non-infringement.
- Limitation of Liability. Under no circumstances shall Hex shall be liable to you or any person affiliated with you for any indirect, exemplary, special, punitive or consequential loss or damages (including but not limited to loss of profit, loss of opportunity and loss of goodwill) whether arising out of breach of contract, tort or otherwise, regardless of whether such damages were foreseeable and regardless of whether either party was advised of the possibility of such damages. The liability of Hex under these Terms shall be strictly limited to direct losses arising from the gross negligence or wilful misconduct of Hex, and in all instances shall be capped at $100.
8. Confidentiality and Data Security
- Protection of Information: Hex is committed to protecting your personal data. However, you understand that your profile information will be shared with prospective employers as part of the matching process, and Hex cannot control third-party handling of that data once shared.
9. Termination and Right to Refuse Service
- Breach of Terms: Hex reserves the right to suspend or terminate your access to the platform at any time if you violate these terms or Hex deems it necessary for security or integrity reasons.
10. General Provisions
- Modifications: Hex may update these terms from time to time. Continued use of the platform constitutes acceptance of any updates.
- Acknowledgement: By using the Hex platform, you acknowledge that Hex’s role is limited to facilitating job matches and does not extend to managing or ensuring employment terms.
- Governing Law. These Terms shall be governed by the laws of the Province of Ontario and you hereby submit to the exclusive jurisdiction of the courts of the Province of Ontario.
- Relationship of Parties. Neither these Terms nor your use of the Hex platform shall create any agency, joint venture, partnership or other form of joint enterprise, employment or fiduciary relationship between you and Hex. Neither party has any express or implied right or authority to bind the other party to any contract, agreement or undertaking with any third party.
- Entire Agreement. These Terms constitute the entire agreement between the parties and replace any previous agreement or arrangement.
- Severability. If any provision of these Terms are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
Language. You agree that these Terms and other communications delivered with respect to these Terms be expressed in the English language. Les parties conviennent que les présentes Modalités ainsi que toutes les communications s’y rattachant soient rédigées dans la langue anglaise.
